After reviewing this case online and having extensive experience in Military as well as Local and Federal law Enforcement : US Army Cav 1964-1968..LAPD 4 years,US Customs Patrol Officer Mexican border 12 years GS 1884-11,and 1 year Reserve Deputy Storey County Nv Sheriff. I am appalled by the lack of professionalism /control on the Deputies part as well as the Monterey County Sheriff ~Scott Miller and the Monterey County District Attorney's office...
I strongly urge the District Attorneys Office to drop charges as well as The Sheriff! You are a embarrassment to all who serve and those veterans who have served..I know where you are coming from you were embarrassed and instead of apologizing for the lack of experience on the Deputies part you notched it up and went for a warrant to cover your proverbial asses..Monterey County is not anywhere I would visit anytime soon!

CIRCUMSTANCES THAT MAKE THIS STORY SO STRANGE. NICOLAS AQUINO WAS IN HIS OWN HOME WHEN DEPUTIES ARRIVED AND BEGAN TREATING HIM AS A BURGALAR... EVENTUALLY FORCING HIM TO THE GROUND AND CUFFING HIM. ACTION NEWS REPORTER TOM MILLER IS LIVE WITH MORE ON THE CHARGES AQUINO IS FACING AND WHY HE'S CRYING FOUL. ## DEPUTIES SAY AQUINO FAILED TO HAND OVER OVER HIS I-D... AND BELIEVING HE WAS A BURGLAR MOVED TO DETAIN HIM... THEY MAKE THE CLAIM THAT WHILE ALREADY ON THE GROUND AQUINO TRIED TO RESIST THEM... AND ARE NOW PRESSING CHARGES. 1:56 All he said was, I need to see your ID at that moment I'm like excuse me sir but who are you and why are you here 2:08 STANDING ON HIS OWN FRONT PORCH AIR FORCE CAPTAIN NICOLAS AQUINO WAS SURPRISED TO FIND A SHERIFF'S DEPUTY IN HIS YARD LAST DECEMBER. 2:27 he says it again, I have to produce identification, at that moment I ask him am I being detained and he said yes and so I said okay then my name is Nicolas Aquino, I live right here, I'm in the military. CAPTAIN AQUINO EVENTUALLY PULLED OUT HIS WALLET AND SHOWED A MILITARY ID CARD BUT DIDN'T HAND IT OVER ACCORDING THE DEPUTY "THE MALE THEN PULLED HIS HAND AWAY FROM ME, THEREBY MOVING THE CARD AWAY FROM MY HAND. I DECIDED AT THAT POINT I WOULD DETAIN HIM PHYSICALLY AND PLACE HIM INTO HANDCUFFS." 3:18 that's when he grabs my wrist, puts me in a front guiateen, slams my head into the ground and spins around and does a rear naked choke so he puts me in a choke hold 3:32 IN THE INCIDENT REPORT THE DEPUTY WRITES THAT WHILE SITTING ON TOP OF AQUINO AND WITH HIS HANDS AROUND HIS HEAD "I YELLED AT THE MALE TO PUT HIS HANDS OUT TO HIS SIDES... THE MALE NEVER COMPLIED... HE WAS BEGINNING TO DRAW THEM IN CLOSER TO THE CENTER OF HIS BODY ... AFRAID THAT THE MALE WAS GOING TO REACH FOR A WEAPON... I CONTEMPLATED DISENGAGING FROM HIM, DRAWING MY OWN FIREARM, AND TAKING AIM" 4:27 I physically can't move, I'm not resisting but I can't move 4:31 CAPTAIN AQUINO SEEN IN THIS AIR FORCE VIDEO TOUTING HIS SERVE... WAS EVENTUALLY CUFFED AND THEN RELEASED WHEN HE SHOWED THE DEPUTY BILLS WITH HIS NAME AND ADDRESS ON IT. HE WAS NEVER ARMED WITH A WEAPON AND NEVER ARRESTED. HOWEVER MORE THAN SEVEN WEEKS AFTER THE INCIDENT... A WARRANT WAS ISSUED FOR HIS ARREST. 28:16 aquino says he didn't find out about the arrest warrant until his supervisor at the naval post graduate school called him to tell him adding that we hasn't allowed back on campus until he dealt with it 28:25 15:28 I asked him what warrant, I don't know what you're talking about because I haven't been notified of anything 15:37 AQUINO'S LAWYER ASKED THE DISTRICT ATTORNEY TO DROP THE CHARGES BUT WAS TOLD IT WASN'T GOING TO HAPPEN... HE SAYS HE'LL ASK ONE MORE TIME BEFORE PREPAIRING TO TO BATTLE IT OUT IN COURT. THE SHERIFF'S OFFICE DID RECIEVE A 9-1-1 CALL FROM A NEIGHBOR CLAIMING TO SEE A MAN WALKING AROUND THE HOUSE SUSPICIOUSLY SO THIS DIDN'T COME OUT OF THE BLUE ... BUT AQUINO SAYS IT'S PUT HIS MILITARY CAREER IN JEPORDY... AND HE CAN'T TRANSFER AWAY FROM THE NAVAL POST GRADUATE SCHOOL UNTIL THIS IS RESOLVED. AQUINO HAS A PRETRAIL WEDNESDAY... HE'S BEING CHARGED WITH A MISDEMEANOR FOR ALLEGEDLY RESISTING BEING CHARGED WITH A MISDEMEANOR FOR ALLEGEDLY RESISTING AND OBSTRUCTING A PEACE OFFICER. ON THE CRIME WATCH: FORMER

Monterey County Sheriff Scott Miller has announced his bid for re-election.
U.S. Air Force Capt. Nicolas Aquino is a first-generation American that
joined the United States Air Force as a way to give back to a country
that opened its arms to his parents. He details his parents struggle and
their journey to the United States, and explains what freedom and
service mean to him.
This type of scenario is often what happens when “concerned citizens” are allowed to “see something, say something” about anything they want anonymously, even if they’re flat out lying.
A Carmel, California resident called the police, because he saw someone “acting suspicious” in his neighbor’s home. The thing is, the guy who was in his neighbor’s home was actually the homeowner himself, a Captain in the Air Force, Nicolas Aquino. I don’t know how he was “acting suspicious” in his own home. Perhaps he was looking for something, and it looked like he was a burglar.
Whatever the case, the phone call prompted Monterey County police to investigate this man as a burglary suspect, who’s now being charged with “resisting arrest” and “obstruction of a peace officer.” NBC News affiliate KSBW reported:
