Oklahoma Legislature Pushing to Nullify Federal Gun Legislation, Follows Kansas’ Lead

Following Kansas’ lead, the Oklahoma legislature is pushing a resolution to nullify unconstitutional federal gun laws.
“On April 16, 2013 in the highest tradition of statesmanship and in keeping with their oath of office,” the resolution states. “The Kansas duly elected Kansas legislature and governor nullified all federal laws and regulations within the borders of Kansas that are in violation of the second amendment to the United States Constitution.”
In addition to noting the progress that Kansas government has made in protecting their constituents’ rights from the federal government through nullification, the Oklahoma resolution recognizes every man’s individual and natural right to self-defense. The resolution expressly states, the “second amendment to the United States Constitution expressly and specifically prohibits the federal government from regulating the unalienable right to self-defense via bearing arms.”
The resolution derives its power from the Ninth and Tenth Amendments.
The resolution concludes, saying, “the Oklahoma House of Representatives reaffirms its commitment to nullifying and interposing all unconstitutional laws in keeping with the oath of office taken by all members of the Oklahoma House of Representatives.”

Kansas Governor Sam Brownback who signed his state’s federal gun-control nullification act has come under fire from Attorney General Eric Holder who in a letter said “Kansas may not prevent federal employees and officials from carrying out their official responsibilities [and] … certainly may not criminalize the exercise of federal responsibilities.”
The Kansas Executive responded to the U.S. Attorney General, saying “The people of Kansas have clearly expressed their sovereign will. It is my hope that upon further review, you will see their right to do so.”
