First and foremost all of the evidence has not been released in full...so I am limited on a response.
Was there probable cause by the officers to arrest Mr.Gray? On the surface it appears as yes...being that the officers were well aware of Mr. Grays past criminal history and the fact that Mr.Gray bolted when he was approached by the officers in a known narcotics sell area.
Now after Mr.Gray was apprehended... after a reported one mile foot chase..a concealed knife was found on a convicted known felon...at this point it does not matter if it was a folding knife or a switch blade ~which is illegal even for a non felon. Any concealed weapon is forbidden by a convicted felon...PERIOD
Apparently no narcotics were found on Mr.Gray...however considering a one mile foot chase Mr.Gray could have disposed of the contraband during the foot pursuit and was not found.
So this addresses the probable cause issue on behalf of the officers to arrest Mr.Gray!
Was there probable cause by the Baltimore DA Marilyn Mosby to levy a 2nd degree murder charge and manslaughter charges against the officers at this point and time of the investigation/ arrest process...It appears as not at this point..it appears as if the DA rushed to judgement as a political matter rather than a judicial matter!
Was there probable cause for civil charges of culpable negligence/misconduct by the officers for failing to protect the arrested Mr.Gray from physical harm as well as failure to get Mr.Gray prompt medical care?...Absolutely yes! Is it possible excessive force was used during the arrest?...it is possible...however nothing has been released to justify this charge as of yet!
So this is all I have to say on this matter and will digress until all of the evidence is released!
