Our lawless President takes issue with adherence to the rule of law.


The Alabama Supreme Court has agreed to expedite our petition requesting that probate judges cease the issuance of same-sex marriage licenses. Meanwhile, the mainstream media is vilifying Alabama Supreme Court Chief Justice Roy Moore and Liberty Counsel for our staunch defense of the rule of law and natural marriage.

The Alabama Supreme Court is taking a close look at our petition and may soon weigh in on the probate judges that are violating Alabama law that permits marriage licenses only for opposite-sex couples.

 
The probate judges must follow the law, which was clearly set forth in Chief Justice Roy Moore's Administrative Order. No single federal judge has jurisdiction over all the Alabama probate judges.

Judge Callie Granade's opinion last month regarding Alabama's marriage laws has no basis in the U.S. Constitution. There is no constitutional prohibition against a state affirming the natural created order of marriage as the union of a man and a woman. Her ruling does not automatically create a law that validates same-sex marriages, as is being alleged by legal activists, the media, and the ACLU.

Judge Grande does not have authority to order all probate judges to issue marriage licenses to same-sex couples. The law in Alabama remains that marriage is the union of one man and one woman! 


Because of our unified stand, pro-homosexual media outlets all over the nation are advancing the legal opinion of any legal activist in order to justify their demonization of Chief Justice Moore and Liberty Counsel.

President Obama also managed to weigh on on Judge Moore's stance by telling Buzzfeed, "When federal law is in conflict with state law, federal law wins out.  I think the courts at the federal level will have something to say to him."

 
Mr. President, the opinion of one federal judge on a specific issue does not create a new "law" as Judge Granade has attempted to do. When the United States Supreme Court rules this summer, there will be a national federal standard. Right now, we have  the judicial activism of one federal judge who has no authority over the state's probate judges. Until the Supreme Court rules otherwise, Chief Justice Moore is correct in adhering to the Alabama Constitution

+ + North Carolina is the latest battlefront.

Liberty Counsel has filed suit on behalf of magistrates in North Carolina who are being pressured to officiate same-sex "weddings" or face suspension, termination, fines, or prosecution. Our clients have been forced to choose between "deprivation of constitutional rights and continued employment, or freedom," Liberty Counsel told the court in our lawsuit.

Our case in North Carolina is typical of the conflicts erupting across the United States as intolerant activists impose their will on the majority of Americans who refuse to endorse or participate in same-sex unions.

 
Walt, as I wrote on Saturday, we need your financial support to help us aggressively defend these magistrates, probate judges, pastors, bakers, photographers, business owners, event planners, and others from what will be an all-out legal assault from organizers of the radical homosexual movement, the ACLU, and the misguided media who continue to demonize law-abiding people.
